Gammix Limited has declared its firm stance against the "excessive and unfounded" penalty imposed by the Netherlands Gaming Authority (KSA).
In a bold move, Gammix denounced the record €19.7m fine, labeling it as based on "fabricated data, gross inaccuracies, and dubious calculations."
The KSA's ruling accuses Gammix of permitting Dutch consumers access to online gambling services and neglecting age verification during sign-up, allegations vehemently denied by the company.
According to Gammix, the accounts used to access its platforms during the investigation originated from Luxembourg, with credit card deposits. The company asserts that such actions violate its terms and conditions, particularly regarding the provision of false information during registration.
Challenging the penalty's calculation method, Gammix contests the use of figures from a proprietary web-traffic aggregator and a multiplier of 240 Euros per click, arguing that it inflates turnover artificially.
Moreover, Gammix criticizes the KSA's investigative approach, referring to it as akin to a "mystery shopper" strategy, which the operator deems an unjust basis for such a substantial penalty.
Phil Pearson, Director of Gammix Limited, remains resolute in the face of adversity, promising to pursue every avenue until justice is served.
Pearson stated: "The KSA has levied a penalty against our company that is both unwarranted and unsupported. We are prepared to fight relentlessly on all fronts because this represents an extraordinary and unduly harsh action from a regulator known for its unyielding stance.
"When we first became aware of the potential penalty, we took proactive measures and reached out to the KSA to demonstrate our compliance efforts. However, our attempts to engage in constructive dialogue were met with silence. We also sought information from the regulator through legal channels, yet received no response.
"We have implemented robust measures to prevent Dutch traffic, including IP blocks and exclusion of Dutch language and payment options. While we cannot control affiliate activities, we ensure that our promotions do not target Dutch players directly.
"This fine is unjustifiable, and we will challenge it at every juncture until it is retracted and an apology is issued."
Pearson concluded: "We are committed to upholding our integrity and will not relent until this egregious penalty is overturned and our reputation restored."
